These Terms of Use (the "Terms") govern your access to and use of lakeclaydreamaway.com (the "Site"), operated by Lake Clay Dream Away LLC ("we," "us," "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2. About This Site
The Site provides information about our vacation rental home in Lake Placid, Florida, and ways to reserve a stay. Content on the Site is for general information and does not constitute a binding offer of availability or price.
3. Bookings & Reservations
Reservations made through Airbnb or VRBO are contracts processed by those platforms and are governed by their terms of service and the cancellation policy shown at checkout. Reservations made directly with us ("VIP Direct") are governed by our Rental Policies and the written terms in your booking confirmation. No reservation exists until we confirm it in writing.
4. Accuracy of Information
We work hard to keep the Site accurate, but rates, availability, amenities, photographs, and descriptions may change without notice and may contain errors. We reserve the right to correct errors and update content at any time.
5. Intellectual Property
All content on the Site — including text, photographs, drone imagery, graphics, logos, and design — is owned by Lake Clay Dream Away LLC or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, except for personal, non-commercial viewing.
6. Acceptable Use
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping content, transmitting malware, or using the Site for any unlawful purpose.
7. Watercraft Waiver
Use of the watercraft provided at the property (kayaks and john boat) requires the responsible renter to complete our Watercraft Safety and Liability Waiver before use. Watercraft use is otherwise not permitted.
8. Third-Party Websites & Services
The Site contains links to third-party websites and services (including Airbnb, VRBO, WhatsApp, and Google Forms). We do not control and are not responsible for their content, policies, or practices. Your use of those services is at your own risk and subject to their terms.
9. Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LAKE CLAY DREAM AWAY LLC AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY ARISING OUT OF THE USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing in these Terms alters the terms of any rental agreement or waiver applicable to your stay.
11. Indemnification
You agree to indemnify and hold harmless Lake Clay Dream Away LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.
12. Copyright Complaints
If you believe content on the Site infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to info@lakeclaydreamaway.com with the subject line "Copyright Notice."
13. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Site will be brought exclusively in the state courts located in Highlands County, Florida, and you consent to personal jurisdiction and venue there.
14. Changes; Severability
We may revise these Terms at any time by posting an updated version on this page; continued use of the Site constitutes acceptance. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
